born before July 2006 and who would have automatically become a British citizen had his or her parents been married to each other, or,
born before 1983 and who would have automatically become a British citizen in 1983 had his or her mother been treated as a married male under the law in force before 1983, or,
who is a British Overseas citizen, British subject, British National (Overseas) or British protected person and has no other citizenship, or
who renounced British citizenship or pre-1983 citizenship of the United Kingdom and Colonies and has a connection with the UK or remaining British Overseas territory, or
who is a British overseas territories citizen who did not automatically become a British citizen on 24 February 2002.
British Citizenship Through Mother
If a person born before 1 January 1983 outside the UK and his/her mother was born in the UK or a former colony that person can acquire British citizenship by registration or obtain “Right of Abode” stamp in your passport. For registration, Good character requirements applies as long as Secretary of state is satisfied that applicant is a person of a good character.
Before 1 January 1983 British citizenship could not be passed on through female line. Children born before 1983 can now acquire British citizenship by registration application to the Home Office. British Citizenship may also acquire if one of the grandparent was born in the UK and either was born in a former colony.
Child Registration as a British Citizen
Children who have automatically acquired British citizenship do not need to be registered. There are two ways a child can automatically be a British citizen without needing to register. Children must be under 18 years old when the application is made. Once they reach the age of 18 they must apply for British citizenship as adults, either by registration where they have an entitlement, or by naturalisation.
A child born in the UK whose parents are not British citizens and were not settled in the UK will have an entitlement to register when their parents become settled in the UK or become British citizens
A child born in the UK on or after 13 January 2010 whose parents are not born British citizens and were not settled in the UK will have an entitlement to register if either parent becomes a member of the UK armed forces.
A child born in the UK, who has lived first 10 years of his/her life in the UK without any significance absences and child could not claim citizenship through parents status.
British citizenship doesn’t transcend to the second generation born abroad. Those children born to parents who became British by descent can also be registered their children if they can demonstrate their residence in the UK prior to the child’s birth.
